Pyxis Suisse SA is a consulting and training company specialising in Agility, registered in the commercial register of the canton of Vaud, Switzerland, under IDE CHE-436.164.492. Its registered office is at rue du Simplon, 37, c/o CBC-L Sarl, 1006 Lausanne. Pyxis Switzerland designs and delivers training courses, training programmes and coaching programmes, both public and private, face-to-face and in LVC*.
Objects of attendance GTC
These general terms and conditions of business (hereinafter “GTC”) define the contractual relationship and the conditions of service between the purchaser (hereinafter “customer” or “participant”) and the service provider, Pyxis Suisse SA (hereinafter “Pyxis” or “Pyxis Suisse”). They apply to the services of training courses, training programmes and coaching programmes, both public and private, both face-to-face and in LVC* offered by Pyxis Switzerland (hereinafter “courses” or “trainings”).
Any registration for a training course, a training programme or a coaching programme implies the full and unreserved acceptance by the Client of these general terms and conditions of sale, which prevail over any other document given to the Client.
The parties to the contract relating to the Courses are the natural or legal person who signs the registration, i.e. the Customer on the one hand, and the company Pyxis Suisse on the other.
Courses offered
The websites pyxis-suisse.ch and campusagile.com are the official media for public courses and programmes. Pyxis Suisse can also provide private, intra-company training courses and programmes.
Registration
By registering, the Customer acknowledges having read the required preliminary level and the general terms and conditions of sale.
a. Registration for the courses must be made on the pyxis-tech.com website.
b. The Customer must enter his information (surname, first name, email and billing information) online and validate his registration by clicking on Confirm.
c. The Client will then automatically receive an email indicating that their registration has been accepted and the invoice for the course chosen.
d. A few days before the course, the customer receives an email from Pyxis Switzerland with all the information related to the course (preparation, location, address, etc.).
Registrations are considered valid as soon as the customer has clicked on Confirm and Pyxis sends a confirmation email with the invoice to be paid. Registrations become effective when Pyxis Switzerland receives payment within the specified period (cf. section Financial conditions, settlement and payment methods).
Financial conditions, settlement and payment terms
Following validation of his online registration on the website, the Client receives a confirmation email with the course invoice attached. Payment for the course(s) or programme(s) for which the Client has registered must be made by bank transfer on receipt of the invoice and no later than 7 days before the date of the course concerned. The information of the account to which the transfer should be made is available on the invoice.
Any training day started or completed is due and will be invoiced to the Client on the basis of 100% of the current rate.
Prices
Prices are quoted in Swiss Francs. The course must be paid upon receipt of the invoice and at the latest 7 days before the start of the course. The invoice cannot be paid in instalments.
Promotional offers (Early Bird rate, Loyalty rate, etc.) cannot be combined.
Cancellation, absence or postponement
Any cancellation, absence, withdrawal by the Participant before the start of the course or stoppage during the training must be notified to Pyxis Switzerland in writing via an email sent to suisse.info@pyxis-suisse.ch.
1. Cancellation by the Customer
For face-to-face trainings or training programmes:
> No later than 21 days before the course date: if the Client cancels his participation no later than 21 days before the course date, the Client’s registration will be cancelled without charge. If the course has already been paid for, the full amount will be returned to the client. If the Customer wishes to postpone his participation to another course offered on the calendar, Pyxis Switzerland will postpone his participation to another date scheduled on the calendar at no additional cost.
> If the cancellation occurs less than 21 calendar days before the start of the course, 10% of the price of the course will be invoiced.
> If the cancellation occurs less than 14 calendar days before the start of the course, 50% of the course price will be charged.
> If the cancellation is made less than 4 working days before the start of the course, 100% of the course fee will be charged.
> If the client is absent from the course, 100% of the course fee will be charged.
For LVC training courses or training programmes*:
> No later than 14 days before the course date: in case the Client cancels his participation no later than 14 days before the course date, the Client’s registration will be cancelled without charge. If the course has already been paid for, the full amount will be returned to the client. If the Customer wishes to postpone his participation to another course offered on the calendar, Pyxis Switzerland will postpone his participation to another date scheduled on the calendar at no additional cost.
> If the cancellation occurs less than 14 calendar days before the start of the course, 10% of the price of the course will be invoiced.
> If the cancellation occurs less than 4 working days before the start of the course, 50% of the price of the course will be charged.
> If the cancellation is made less than 24 hours before the start of the course, 100% of the course fee will be charged.
> If the client is absent from the course, 100% of the course fee will be charged.
2. Cancellation due to Pyxis Switzerland
> Linked to an insufficient number of registrants
Pyxis Switzerland reserves the right to cancel a face-to-face course up to 7 days prior to the course date and up to 3 days prior to the date for a LVC* course if there are not enough participants. In this situation, Pyxis will propose a suitable alternative to the Customer (e.g. postponement of the enrolment). If no alternative can be found, the registration fee will be fully refunded to the Customer.
> Linked to an external event
If the cancellation of the course is the result of a force majeure or fortuitous event (trainer ill or victim of an accident, external social conflicts, natural disasters, fires, floods, malfunctioning of communication tools, transport problems of any kind … and other circumstances that may be beyond the control of Pyxis Switzerland), the Participants registered for the course will have to choose among the following options:
– Postpone their participation to another course offered by Pyxis Switzerland, at no extra cost.
– Cancel their participation. In this case, the full amount paid will be returned to them by bank transfer.
Pyxis Suisse will under no circumstances reimburse all or part of the transport or accommodation costs incurred by the Customer to attend the course. It is the Customer’s responsibility to favour options that can be cancelled at no cost in order to be reimbursed in the event of cancellation of the course.
3. Postponement of the Client’s participant
If the Customer is unable to attend the course for which he has registered, the Customer has the option of postponing his participation in a course offered by Pyxis Switzerland to a later date. This change of date is free of charge if the Customer has made a request to Pyxis at least 14 days before the course. In the event that the postponement occurs less than 4 days before the date of the course and if expenses have been incurred by Pyxis Suisse for this course (room hire, meal reservations, etc.), 150CHF in penalties will be invoiced to the Customer.
Responsibilities and obligation
Pyxis Switzerland is bound by an obligation of means and not of result towards its Clients.
It cannot be held liable vis-à-vis the latter in the event of non-performance of its obligations resulting from a force majeure or fortuitous event (as described above).
Pyxis Suisse is not liable in the event of failure by the participant in the examinations linked to the certified training courses in the catalogue.
Applicable law and jurisdiction
These General Terms and Conditions of Sale are governed by Swiss law.
Data protection
Pyxis Suisse SA respects the confidential nature of the personal data communicated by its Clients and Participants and complies with the legal provisions on data protection.
Private “in-company” courses or programmes
Courses, training programmes or coaching programmes given in-house for companies are subject to a different booking and contractualisation process. Pyxis Switzerland shares a price proposal with the client as part of a quote. The sale is considered to be effective once the customer has accepted the proposed offer, by positive return to the email or by returning the signed quotation with the mention “good for agreement”. All the conditions mentioned in this document are valid for courses sold and carried out privately.
Payment terms specific to coaching programmes: A coaching programme is carried out over several months. In this context, the payment of a coaching programme will be spread out as follows: one third of the total amount before the start of the programme, another third at the halfway point and the last third at the end of the coaching programme.
